Welcome to Swift Earns! These Terms and Conditions govern your use of the Swift Earns app and services. By accessing or using Swift Earns, you agree to comply with and be bound by these terms. If you do not agree to these terms, please refrain from using our platform.
1. Definitions
- “App”: Swift Earns, including its mobile and web versions.
- “User”: Anyone who uses the App, including service providers (Sellers) and clients (Buyers).
- “Services”: Freelance work offered on the platform, such as web design, programming, etc.
- “Seller”: Users who offer services.
- “Buyer”: Users who purchase services.
2. Eligibility
- Be at least 18 years old or the legal age of majority in your jurisdiction.
- Comply with all local laws and regulations applicable to your use of the app.
- Register an account with accurate, complete, and up-to-date information.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify Swift Earns immediately of any unauthorized use.
4. Services, Payments, and Fees
Sellers may offer services and set pricing. Buyers may purchase services directly from Sellers through the platform.
Payments are processed via Stripe. By paying or receiving funds, you agree to Stripe’s Terms and Privacy Policy. Swift Earns may charge platform/service fees disclosed at checkout. Payouts to Sellers occur after service completion and Buyer confirmation, subject to Stripe clearance and fraud checks.
Taxes are the responsibility of Users. Sellers are responsible for assessing, collecting, and remitting any applicable taxes on their services.
5. Platform Role
Swift Earns is a marketplace platform. Sellers provide services directly to Buyers. Except where explicitly stated, Swift Earns is not a party to contracts between Buyers and Sellers and does not control or guarantee service quality.
6. Delivery, Acceptance, and Refunds
Services are typically delivered off-platform (in person or remotely). A service is deemed completed when the Seller delivers per the agreed specifications and the Buyer accepts, or after a reasonable acceptance period if no issues are raised.
Refunds: Buyers may request a refund within 7 days of delivery where deliverables materially deviate from agreed specifications. Parties should first attempt to resolve issues directly; Swift Earns may facilitate but does not adjudicate disputes.
Chargebacks: Handled per Stripe’s process. You authorize Swift Earns to provide relevant information to Stripe for dispute resolution and to debit your account for chargeback amounts and associated fees.
7. Intellectual Property
Unless otherwise agreed in writing, upon full payment, Sellers grant Buyers a worldwide, non-exclusive license to use the deliverables. Sellers retain rights in background materials, tools, and know-how used to create the deliverables.
Users must not upload or provide content that infringes third-party rights.
8. User Conduct
- No fraud, spam, or illegal activities.
- No IP infringement or violation of others’ rights.
- No circumvention of the platform for transactions initiated on Swift Earns.
9. Ratings and Reviews
We may moderate or remove reviews that are abusive, off-topic, or violate these terms.
10. Suspension and Termination
We may suspend or terminate accounts for violations of these terms, fraud, or legal/regulatory reasons. Upon termination, access to balances may be limited pending resolution of disputes or chargebacks.
11. Disclaimer of Warranties
The platform and services are provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law, Swift Earns’ aggregate liability for claims arising out of or relating to the Services shall not exceed the greater of $100 or the fees paid by you to Swift Earns in the 3 months preceding the event.
13. Indemnification
You agree to indemnify and hold harmless Swift Earns from claims arising out of your use of the Services, your content, or your violation of these terms or applicable law.
14. Governing Law and Dispute Resolution
These terms are governed by the laws of your country/state of residence unless mandatory local consumer protections apply otherwise. Where permitted, disputes will be resolved in the courts of the principal place of business of Swift Earns, and you waive class actions to the extent permitted by law.
15. Changes to These Terms
We may update these terms from time to time. Material changes will be notified via the app or email. Continued use after changes constitutes acceptance.
